These Terms of Service ("Terms") govern your access to and use of the QuickFlow platform and services ("we", "us", or "our"). By using our services, you agree to be bound by these Terms.
QuickFlow is a WhatsApp Business API platform that provides automated chatbot solutions, AI-powered messaging, and system integrations for businesses. Our services include chatbot design and deployment, message automation, CRM and third-party integrations, analytics and reporting, and ongoing platform support.
To use QuickFlow, you must provide accurate business and contact information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised access or security breach.
You agree to use QuickFlow in compliance with all applicable laws and regulations, including but not limited to South Africa's Protection of Personal Information Act (POPIA), the Electronic Communications and Transactions Act (ECTA), and Meta's WhatsApp Business Policy. You may not:
QuickFlow operates on a monthly subscription model. Pricing is based on your selected package tier and usage volumes. We review customer volumes monthly and automatically apply the best package for your usage. All prices are quoted in South African Rand (ZAR) and are exclusive of VAT unless stated otherwise. WhatsApp messaging fees charged by Meta are billed separately. Payment is due within 30 days of invoice date unless otherwise agreed. We reserve the right to suspend services for overdue accounts.
Setup, chatbot design, custom integrations, and training are available through our preferred professional services provider, Servsol Software Solutions, and are quoted separately from the monthly platform subscription. The scope and cost of professional services will be agreed upon before work commences.
We aim to maintain high platform availability and will make commercially reasonable efforts to ensure service uptime. Scheduled maintenance will be communicated in advance where possible. We are not liable for downtime caused by factors beyond our reasonable control, including third-party service disruptions (such as Meta/WhatsApp outages), internet connectivity issues, or force majeure events.
You retain ownership of all data you upload to or generate through the QuickFlow platform, including customer conversation data. We process your data solely to provide and improve our services, in accordance with our Privacy Policy. As a data processor (operator under POPIA), we act on your instructions and maintain appropriate security safeguards.
The QuickFlow platform, including its software, design, branding, and documentation, is the intellectual property of QuickFlow. Your subscription grants you a limited, non-exclusive, non-transferable licence to use the platform for the duration of your agreement. Custom chatbot flows and content created for your business remain your intellectual property.
Both parties agree to maintain the confidentiality of any proprietary or sensitive information exchanged during the course of the service relationship. This obligation survives termination of the agreement.
To the maximum extent permitted by law, QuickFlow shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability for any claim shall not exceed the amount paid by you for the services during the three months preceding the claim. We are not responsible for the content of messages sent through the platform by you or your customers.
Either party may terminate the service with 30 days' written notice. We may suspend or terminate your access immediately if you breach these Terms, fail to make payment, or engage in activity that could harm the platform or other users. Upon termination, we will provide a reasonable period for you to export your data.
We may update these Terms from time to time. Material changes will be communicated via email or through the platform. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of QuickFlow shall be subject to the jurisdiction of the courts of the Western Cape, South Africa.
